WINNING THE SUBPRIME TRIAL
An Akerman trial team led by Jim Miller recently won a $7+ million jury verdict in a case involving a portfolio of subprime loans. The trial yielded many lessons including the effectiveness of humanizing an institution, like a bank, for a jury. Esoteric and mysterious topics like subprime loans and warehouse lending had to be demystified for the jury. And, complex damages had to be proven without an expert. This case was prepared and won without a single deposition -- not always possible but sometimes necessary -- and desirable.
