With 1.7 million traumatic brain injuries ("TBI") annually in the U.S. and another 200,000 or so in Canada, plaintiffs are now blaming TBI for lack of restraint, disregard for social conventions, impulsivity and poor risk assessment. Plaintiff counsel are now linking hypersexuality, hyperphagia and aggressive outbursts to prior TBI's. Claims for medical monitoring and 24-hour care are proliferating.
