NIXON PEABODY DEFENSE VERDICT FOR CARDINAL HEALTH
Nixon Peabody's Dan Hurteau and Elizabeth Byrne-Chartrand successfully defended Cardinal Health 2000 f/k/a Baxter Healthcare in a product liability lawsuit. After a week long trial, Judge Monserrate decided in Cardinal Health's favor at the close of evidence on the issue of liability. As a result, judgment and all costs were awarded in favor of Cardinal Health.

THOMPSON HINE'S TONY WHITE FEATURED IN OHIO'S RISING STARS SUPER LAWYERS 2006
The competitive fire of an Ohio State power forward still sizzles in Tony White, only now it’s displayed in court rather than on the court. “The closest thing to getting elbowed in the nose in the Big Ten is to be a trial lawyer,” says White, partner-in-charge of Thompson Hine’s Columbus office since June 2005. In basketball, “you’re fighting tooth and nail for two hours to win a game. It takes the same kind of preparation and dedication to win a jury trial.”

He relishes the competition, says Chris White, his wife of nearly 11 years. “I’ve never known anyone who plays as hard and works as hard as Tony does. When it’s time to do work, he’s all work. He doesn’t show his dimples
when he’s working.”

White played for the Ohio State University basketball team for four years, serving as captain for the 1988-89 season, his senior year. As a junior, he announced his intention to go to law school. “I was nervously confident I would get in,” he says. “Dick Vitale gave me the nickname ‘The Barrister’ my entire senior year.”

NIXON PEABODY'S JOE ORTEGO HONORED FOR ACTIVE LEADERSHIP IN LONG ISLAND'S HISPANIC COMMUNITY
Joseph J. Ortego of Nixon Peabody Long Island's Products Group was honored by the Town of Hempstead at its annual National Hispanic Heritage Month celebration. Joe was acknowledged for his active leadership in Long Island's Hispanic Community.

Town Supervisor Kate Murray congratulated Mr. Ortego on his professional and personal success, in addition to being a recognized leader in the Hispanic Community on Long Island.

NIXON PEABODY ROCHESTER LAWYERS ACHIEVE BIG WINS FOR XEROX
For several years, Nixon Peabody's Rochester lawyers have been successfully defending shareholder derivative suits against Xerox Corporation and its officers and directors in New York and Connecticut state and federal courts. The cases challenge executive compensation in the face of restated financials.

Recently the firm won a dismissal in Connecticut state court based on lack of standing. Last week the firm won a dismissal in U.S. District Court in Connecticut, again on jurisdictional grounds.

A number of Nixon attorney have participated in this team effort over the last several years, led by Carolyn Nussbaum and Rick McGuirk, with assistance from John Field, John Larimer, Noah Doolittle, Lynnette Nogueras-Trummer and Marisa Miller.
