NEW ATTORNEYS AT WHEELER TRIGG KENNEDY
The Denver-based trial law firm of Wheeler Trigg Kennedy LLP welcomes two new attorneys.
Marian L. Carlson joined Wheeler Trigg Kennedy in June as of counsel. Ms. Carlson has tried cases in state and federal courts involving contract and partnership disputes, officer and director liability, securities fraud, employment claims, and commercial real estate matters.
A 1988 graduate of the University of Denver College of Law, Ms. Carlson has been associated with other Denver law firms, and has written and presented on law practice management and effective legal writing. Ms. Carlson is currently a School to Work Program volunteer for Goodwill Industries and was president of the board and a board member for several years of Community Resources, Inc.
Sean R. Coutain is a new associate at Wheeler Trigg Kennedy working primarily on product liability litigation involving pharmaceuticals. Previously with Proskauer Rose in Los Angeles, Mr. Coutain has a broad range of litigation experience in product liability, state and federal regulatory investigations, appeals, employment matters, and white collar criminal defense. Mr. Coutain is a 2003 graduate of Harvard Law School.

AUTOMOTIVE ROOF CRUSH DEFENSE VERDICT FOR SNELL & WILMER
Snell & Wilmer's Products Group partner Dan Rodman won a defense verdict in June when a jury found for Ford Motor Company in a $22 million rollover case aring from an accident involving a 1985 Ford LTD sedan that left one of the car's seat-belted passengers a quadriplegic.
Plaintiff contended that the roof of the Ford LTD caved in approximately 10" during the rollover and caused plaintiff's spinal cord injury.
Ford contended that the accident was caused by the negligence of the car's driver who allowed the car to drift off of the road and to roll over, that the LTD's roof was not defective and that plaintiff suffered his spinal cord injury before any significant roof crush occurred.
The jury determined that the driver was 100% at fault for the accident and plaintiff's injuries, and that the Ford LTD was not defective.
The jury awarded plaintiff damages of $22 million against the driver for her negligence but zero against Ford.
Dan tried the case with Frank Kelly from Shook, Hardy & Bacon.

Las Vegas' booming legal market is attracting national attention, including from law firms whose clients are expanding there with the local economy. Snell's Las Vegas office, largest in the city, is featured in this month's issue of The American Lawyer which reports:
Tall, handsome, and corporate, Patrick Byrne is . . . the head of the largest branch office in Las Vegas of any Am Law 200 firm, the 27-lawyer outpost of Phoenix's Snell & Wilmer. . . .
[The growth in Las Vegas' legal market is] driven by a housing boom, a hotel boom, an office boom, and, most important, a fundamental shift in Las Vegas's biggest business, gaming.

At 27 lawyers, Snell has the largest out-of-state office. It has steadily added partners and associates in real estate, corporate work, and litigation. In April 2004 Snell hired five lawyers from Las Vegas's Gordon & Silver to handle real estate and construction law matters, a booming practice in a city where construction cranes dot the open landscape. The firm has "a pretty good market share" in representing developers in mixed-use and high-rise condominium developments, says partner James Mace. Clients include Turnberry Associates, The Related Group of Florida, and Ruffin Trump LLC. Still, Snell has not snagged anyone in the critical IP and gaming regulatory areas. Byrne says he is aggressively looking to hire lawyers in those practices.

The inability of Las Vegas's native firms to do major securities work for gaming clients-and the disinterest of elite firms in anything else-creates a balance that the out-of-state firms would like to upset. "My sense is that the market has been underserved on pure corporate transactions and securities work," says Snell & Wilmer's Byrne. "We are doing our best to keep some of that work in the marketplace."
But the local work that Las Vegas firms do is not commodity work, and local counsel means more than a signature. Nevada is the Delaware of the West; many out-of-state companies are incorporated there but headquartered in other states, and Las Vegas lawyers handle incorporations and provide comments on Nevada law.
